These Terms of Use govern your use of BigDealz. By using the app you agree to everything below — please read it carefully.
1. General
Welcome to BigDealz, an application for automatically finding deals, coupons, and promotions on Amazon products shipped to Israel. Through the application you can contact sellers on Amazon directly; the application serves only as an intermediary (hereinafter: "the Services" and/or "the Products"). The application is owned and operated by Amit Kupfer Marketing Ltd., company no. 201455557 (hereinafter: "the Application" and/or "the Operator"). These Terms of Use govern the relationship between the Application and anyone browsing and/or using the Application or the information it contains (each hereinafter: "the Customer" and/or "the User"). Any use of the Application and its content, including browsing it and any action taken within it, is subject to the Terms of Use detailed below, which users are asked to read carefully. You are not obligated to agree to these Terms; if you do not agree, you must exit the Application immediately and make no use of it. Beginning to use the Application constitutes your agreement to these Terms without any limitation or reservation, and by using the Application you undertake that neither you nor anyone on your behalf will have any claim or lawsuit, directly or indirectly, against the Application, its operators, owners, managers, or anyone acting on their behalf. This document is written in the masculine form for convenience only and applies equally to all genders. Section headings are for convenience and orientation only and do not affect interpretation. Access to and use of this Application, including all content, information, services, and products appearing in it from time to time, is subject to these Terms and to any applicable law of the State of Israel. The Application and its content are intended solely for private, non-commercial use, limited to the purpose of receiving the Services; no product may be copied, reproduced, distributed, sold, or displayed without the Operator's prior written permission. Anyone performing any action in the Application, or relying on any representation in it including inventory and prices, thereby declares that they have read, understood, and agreed to these Terms. The Customer declares they are legally competent to enter into binding actions; a Customer under 18 must inform their legal guardian of these Terms and obtain prior approval before using the Application. The service is provided within the State of Israel, in specific areas defined from time to time at the Operator's sole discretion ("the Service Area"). The Customer undertakes to indemnify the Operator for any damage caused by providing false details or disrupting the Application's operation. Instructional videos, images, and product presentations are illustrative only and do not bind the Operator.
2. Use of the Application
The Application is a search engine only, which scans thousands of products at good prices relevant for shipping to Israel via suppliers on Amazon; through the Application you can go to the product page on Amazon and purchase directly from the supplier. No purchase is made within the Application itself - it serves only as an intermediary between users and Amazon sellers, directing users to the product page so the order is placed directly with the relevant supplier on their own page. The Operator's service to its customers is limited to publishing and scanning relevant products; it has no connection to or interest in them and disclaims responsibility for their quality, as Amazon's product suppliers are solely responsible for any product purchased. Purchasing from suppliers is subject to that supplier's own terms of use and privacy policy, which the user must read and accept independently; the Operator bears no responsibility for any disruption or fault in ordering a product from a supplier published on the Application. Displaying and scanning products on the Application does not imply any endorsement or recommendation of a particular supplier - the Operator does not sponsor or have any affiliation with suppliers, and merely scans good deals published on Amazon. All content shown in the Application, including product availability and pricing, is supplied by third parties; the Operator makes its best efforts to present accurate, up-to-date information but does not verify third-party content and cannot guarantee it. It is the Customer's responsibility to verify the information shown in the Application against the information shown directly on the supplier's own page. Payment for the service, invoicing, verifying the payment method, and order confirmation and fulfillment are the sole responsibility of the relevant supplier and are subject to that supplier's terms and privacy policy; the Operator bears no responsibility for the actual completion of a purchase. The Operator is not involved in creating product descriptions, setting prices or fees, or the quality of ordered products; any question, issue, or dispute about an order must be resolved directly with the supplier who fulfilled it.
3. User Consent & Prohibited Conduct
The Application user agrees and declares that, without the Operator's permission, they will not: use the Application for any purpose other than personal use; use automated systems or software to harvest data for commercial or non-commercial purposes; use bots designed to bypass measures restricting access to the Application; use any device, software, or routine that interferes with the Application's normal operation or places an unreasonable load on its servers; reproduce, copy, sell, trade in, or misuse the Application; use its features or content for any unlawful, harmful, or inappropriate purpose; publish or distribute material that infringes a third party's rights or any law; use the Application to collect personal information about others; bypass, disable, or interfere with security features or usage restrictions; impersonate any person or entity, or misrepresent an affiliation with one; violate or encourage, intentionally or not, the violation of any applicable law, regulation, or policy; solicit personal information from another person, or delete, add, or alter other users' content; or publish, distribute, or encourage violent or unlawful content or activity.
4. Operator's Liability
All content and products shown in the Application are information received from third-party suppliers as-is and as available from the system's automated scan, so errors may occur in that information. The Operator does not cover every relevant supplier, offer, or rate available and does not guarantee it will always show the lowest price for a product; it disclaims any warranty, express or implied, including of merchantability, fitness for a particular purpose, accuracy, or security, and any liability arising from commercial use. The Application is only an intermediary between its users and product suppliers, and information in it is not a promise of any result or a warranty for the products offered. The Application is not liable for any direct or indirect damage, loss, distress, or expense caused to users or third parties from using or relying on any content, information, image, video, advertisement, product, or service shown in it or in linked sites, and in particular is not liable for the accuracy or originality of product details. Any such reliance is at the user's sole discretion and responsibility, and users are advised to act carefully, read the displayed information thoroughly, and independently verify the relevant supplier. The Application is offered to the public "as is"; the information may be incomplete or contain technical errors. Use of the Application is entirely at each user's own responsibility, including any decision regarding content published on it, and the Application does not guarantee that content will be complete, correct, lawful, or accurate. The Operator disclaims all liability for any loss, damage, or viruses that may affect a user's computer as a result of accessing the Application or downloading content from it, and for the outcome of any order placed for products advertised on it.
5. Cancellation Policy
As no purchase is made within the Application itself, the cancellation policy is governed by the terms of use and policy of the supplier through which the product was actually purchased.
6. Intellectual Property
All copyright, trademark, and intellectual property rights in the Application, including its content, design, and any software, computer code, graphic file, image, text, or other material it contains, belong solely to the Operator; none of these may be copied, photographed, distributed, publicly displayed, or transferred to a third party, nor may any part of the Application be reproduced, published, marketed, or used to create derivative works. The Application's domain, name, brand name, trademarks (registered or not), and software developed by the Operator are its sole property and may not be used without its prior written consent; all graphics, design, wording, and logos in the Application are its exclusive property and may not be copied, distributed, published, or otherwise used without prior written consent - mere access to the Application grants no license or right whatsoever. The Operator respects the intellectual property rights of others and prohibits users from uploading, publishing, or otherwise transmitting through the Application any material that infringes a third party's intellectual property rights; a user who suspects an infringement of their trademarks or copyrights may contact the Operator at support@bigdealz.co.il.
7. Miscellaneous
These Terms apply to the Application and its services on any computer or communication device (mobile phone, tablet, etc.), and on the internet as well as any other network or communication medium. The Operator reserves the right to change these Terms from time to time, to add to or remove from them, at its sole discretion and without prior notice; responsibility for knowing and following the current Terms rests solely with the user at all times, and continued use of the Application constitutes agreement to any change. The Operator makes every effort to keep the information in the Application accurate, but good-faith inaccuracies or errors may occur, for which it bears no liability. Any conduct by the Operator that benefits a user beyond what these Terms require is a goodwill gesture only and will not be treated as a waiver of these Terms. Any technical malfunction that temporarily prevents use of the Application will be addressed as soon as possible, and users will have no claim regarding it. In any conflict between these Terms and other publications or information provided by the Operator, including on social media, these Terms shall prevail. The Operator reserves the right to discontinue the Application's activity at any time, at its sole discretion, without the user having any claim or lawsuit in that regard.
8. Privacy Policy & Confidentiality
In some cases, users will be asked to provide personal information such as name, address, and email; the Operator takes standard precautions to protect the confidentiality of this information and will use it for internal purposes only, including contacting users, providing quotes, and marketing communications, subject to user consent. Any personal details provided will be stored in the company's database; users declare that the details they provide are true and complete and given freely, and when providing a third party's details, that this was done with that party's explicit consent. Users under 18 confirm they obtained parental or guardian consent before providing personal details. Using the Application may involve collecting information such as pages viewed, products purchased, device and browser type, IP address, and payment method used; logging in via a third-party service (such as Gmail or Facebook) may transfer additional information about you from that service to the Application. This information is subject to this Privacy Policy and to applicable law, including the Israeli Protection of Privacy Law, 1981, the Privacy Protection (Data Security) Regulations, 2017, and the EU's GDPR. An email address or mobile number will only be kept for direct-marketing purposes at the user's request; to opt out, contact support@bigdealz.co.il in writing, and removal will be completed within approximately 14 business days of the request.
9. Use of Information
The Operator undertakes to use its customers' details only for operating the Application, enabling the best possible search and scanning of relevant products, matching products to users, and communicating with and staying in touch with them. The Application may use "cookies" on users' computers and mobile devices - a standard practice among online stores. Information received through the Application, whether provided by the user or collected via a cookie, is for the Application's exclusive use (subject to the user's consent to being added to its mailing list). Notwithstanding this, the Operator may transfer a user's personal details to a third party where the user has committed an act or omission that harms or may harm the Operator or third parties, has used its services to commit an unlawful act, where a court order requires disclosure, or in connection with any dispute or legal proceeding.
10. Security Procedures
The Operator uses strict security standards and advanced software systems to protect its customers' information and privacy as much as possible and to minimize the risk of intrusion or unauthorized exposure; however, no security solution is perfect, and absolute immunity from unauthorized access cannot be guaranteed. The Application is secured via SSL, so that all communication between the browser and the Application's servers is encrypted and cannot be deciphered by a third party. In circumstances beyond the Operator's control or resulting from force majeure, it bears no responsibility for any damage caused to a user from information being lost, reaching a hostile party, or being used without authorization. The Operator makes an effort to provide a proper, high-quality service, but does not guarantee the service will be uninterrupted or free of hardware, software, or communication-line failures, whether on its own systems or those of its suppliers. Information about users is stored in databases managed by the Operator or a third party on its behalf, subject to the Privacy Protection (Data Security) Regulations, 2017; sensitive information such as passwords is stored encrypted, and the databases may be located outside Israel - by using the Application, the user consents to this transfer and storage of their information outside the country.
11. Right to Access Information
Under Israel's Protection of Privacy Law, 1981, users may review the information about them held in the Application's databases, and if they find it incorrect, incomplete, unclear, or outdated, they may ask the Operator to correct or delete it; where information is used to contact them personally, they may demand its deletion. Any such request must be made in writing to the contact details provided in the Application, and it is the user's responsibility to confirm the request was received and is being handled; the Operator bears no responsibility for requests that did not reach it, were not made in writing, or are illegible. A user who believes the Application infringes their privacy, or users' privacy generally, is invited to contact the Operator in writing accordingly.
12. Changes to This Privacy Policy
The Operator reserves the right to update this Privacy Policy from time to time without prior notice; changes take effect within 48 hours of being made. If a material change is made, notice will be posted on the Application's homepage 30 days before it takes effect. Continued use of the Application after an update constitutes acceptance of the updated policy; anyone who does not agree must stop using the Application.
